Judge dismisses racial discrimination lawsuit against Atlas Restaurant Group

(Baltimore, MD) -- A federal judge in Baltimore has dismissed a racial discrimination lawsuit filed against the Atlas Restaurant Group.

Marcia Grant, who is Black, filed the suit after Ouzo Bay restaurant refused to serve her and her nine-year-old son in 2020 because his basketball shorts did not meet the dress code.

Grant questioned why a white child wearing shorts was eating in the restaurant and employees said his shorts were khakis, not gym clothes.

Judge George Russell ruled the dress code was posted and available to the public, so refusal of service was not discriminatory.

After the incident, Atlas issued a press release saying the denial of service should never have happened and two managers were fired.

The restaurant has since changed its dress code, excluding kids under 12, who are with an adult.
