(Baltimore, MD) -- The defense team for Baltimore City State's Attorney Marilyn Mosby can now try to have some of her charges dismissed.
That's the ruling from Federal Judge Lydia Kay Griggsby who originally disagreed.
Mosby withdrew money from her retirement fund through a CARES Act provision for down payments on two Florida vacation homes.
Her defense argues the phrase "adverse financial consequences" is ambiguous and insufficient to support perjury charges.
Mosby also faces two counts of making false statements on mortgage applications.
