Karthikeyan Deenadayalanis is facing a federal charge of violating the Ports and Waterways Safety Act.
A Deferred Prosecution Agreement has been reached meaning the charge could be dismissed if Deenadayalan complies with certain terms.
Prosecutors allege he knowingly and willfully failed to notify the U.S. Coast Guard about hazardous conditions on the Dali before the 2024 collapse that killed six road workers.
In May, an unsealed indictment revealed criminal charges against the ship's owner and operator.
